EU safeguard measures: Chinese chemicals and machinery
SATURDAY, 17 OCTOBER 2026
The European Council calls for quotas and tariffs for the two sectors and a new tool to limit access to the single market. In December comes the proposal against reliance on a single supplier.
EU safeguard measures against Chinese imports will not stop at hybrid cars. At the end of the European Council of 15 and 16 October, Commission President Ursula von der Leyen announced new restrictions, and government leaders named chemicals and machinery as the next sectors to protect with quotas and tariffs.
What the Brussels summit decided
At the press conference on Friday 16 October, von der Leyen said the understanding reached in Beijing the week before does not fix the structural imbalance in trade and that the Commission will respond to industry's calls «including some more safeguards». According to accounts of the summit, leaders asked the Commission to prepare a set of new trade defence instruments, including safeguards with quotas and tariffs for chemicals and machinery, two of the sectors hit hardest by low-priced Chinese imports. According to officials, leaders asked for unilateral safeguards to be introduced «without delay». The summit did not set any new tariffs, however: timing, products and rates are still to be defined.
These are the reference figures:
- EU trade deficit with China in 2025, goods only: about 360 billion euros, more than 1 billion a day.
- Sectors named for the next safeguards: chemicals and machinery, with quotas and tariffs as possible tools.
- Chinese hybrid cars: the safeguard agreed with Beijing aims to halve arrivals in Europe compared with expected growth.
- European supplier diversification instrument: Commission proposal expected in December 2026.
- New tariffs set at the summit: none, for now.
A tool to close access to the single market
The second novelty is political. Von der Leyen announced «a new instrument for decisive action by limiting access to the single market» where this is in the Union's interest, quickly. The idea comes from a Franco-German paper and takes up the instrument modelled on the US Section 301 that has been debated for weeks, which now has the backing of government leaders. It is unclear whether it will be ready by the end of the year. Alongside it, the Commission is preparing a solidarity mechanism to help countries and sectors hit by possible Chinese retaliation.
EU safeguard measures and the single supplier
For companies buying in China the most concrete part is the diversification instrument, which the Commission will present in December. It aims to reduce European companies' reliance on a single source for certain critical supplies; the idea of binding obligations had already appeared in the economic security communication of December 2025. Trade Commissioner Maroš Šefčovič summed it up this way: the cost of diversification is lower than the cost of disruption. Which products will count as critical, and whether the obligations will also apply to small companies, is not yet known.
What it means for importers
No tariff changes today: a shipment leaving this week pays the same duties as yesterday. The deficit figure does not say which products will be hit, but it signals that political pressure has moved up a level, and it is worth preparing before the measures have a text.
A safeguard works differently from an anti-dumping duty: it usually sets a quota for the whole Union and applies an additional duty to quantities above it. When the quota runs out mid-quarter, whoever clears customs afterwards pays more, even with an order signed months earlier. That is why it pays to check now which customs codes in your purchases fall under chemicals, including plastics, paints and adhesives, or under machinery and its components, and whether the order is delivered duty paid or ex works: with a duty introduced during production, the cost falls on whoever lodges the customs declaration.
The second check concerns dependence. For items that come from a single supplier, or from a single Chinese province, it helps to have at least one alternative already qualified, with approved samples and updated prices, even if it is not used straight away.
The next steps
There are two dates to watch: any safeguard investigations into chemicals and machinery, which the Commission must open with a public notice before any measure, and the diversification proposal in December. China's Ministry of Commerce has already called the instrument under discussion protectionist and unilateral, so a response from Beijing to the new measures should be expected.
With La Merce, an order of mechanical components or chemical products from China starts with a check of the customs code against the sectors named at the 16 October summit and with a second supplier already sampled, so a possible quota does not block delivery.
